Justice for the tribe members who paid for subscriptions would be as follows:
1. A full accounting of where their subscription payments went.
2. A full refund of any funds that were not applied directly to maintaining and improving the website, which was the sole purpose for which the funds were solicited.
3. Tee shirts to all the people who were promised one, or a refund of the value of the tee shirts.
4. Prorated refunds for anyone who paid in advance and whose premium account was terminated.
Also, to the extent that premium subscriptions went to pay Darren's salary, Darren should be required to give an accounting of how he spent his time and what, if anything he did to earn this salary, other than unsubscribe and censor his critics and fuck tribe.net into the ground.
It is pretty clear from the vast volumes of his twittering, facebooking, livejournaling, linkedin-ing, and harassing or censoring any tribe.net members who he didn't like that he had little time in an eight hour day to actually work on tribe.net's problems
Pincus your pockets wrote on his blog: "regarding transparency on the business and economics. it has been thanks to the members who purchased subscriptions that tribe has managed to break even and continue. businesses dont normallly share this information but we are open to reconsidering that."
--on the other hand, businesses don't normally demand handouts from their members just to stay in business. So discussions about what is typical for businesses is not really relevant here. When tribe started begging for handouts, it made very specific promises that the money would be used to maintain and improve the site. Those promises constituted a binding contract, which tribe.net has breached. Instead of meeting its contractual obligations, in the past year, Darren has driven the site into the ground.
So, I don't think it is all the generous of Pincus to "consider" some transparancy on its financial status. In fact, I think he is obligated to provide this information. If he won't provide it, we can only assume he ripped us off.
It is typical of Pincus to say something like he is considering transparency, but then not to do it.
In my complaint with the Department of Consumer Affairs I was asked what I would want for restitution based on my complaint. My answer was "A full refund for myself and all paying members on the site"
DCA is considering action
Plan B would have to be a lawyer who would take on such a case. I have not had enough time to investigate it but have considered it.
I am so freakin' pissed off right now!!! Now I don't exist on Tribe at all, and stupidly I paid a year in advance in an effort to help. My account is gone, yet when I try to re-join it says my email address is on the database so it blocks me. So I tried to join with a different email address, never got a reply with the password. You are right, these guys really blew it.
